DISCLAIMER CLAUSE:
The Kitchener Waterloo Minor Boys Softball Association their agents, officials, officers, directors, employees, servants or representatives (hereinafter referred to as .The Association.) is not responsible for any death, injury, loss or risk of damage of any kind suffered, by any person caused in any manner whatsoever, including but not limited to the negligence of The Association or the breach of duty of care prescribed by the Occupiers Liability Act, R.S.O. 1990, by The Association arising out of, associated with or related to participation in The Association and its activities.
AGREEMENT AND INDEMNIFYING RELEASE:
In consideration of my being permitted to participate in the Kitchener Waterloo Minor Boys Softball Association, the Participant or the Parent or Legal Guardian on the Participant.s behalf hereby acknowledge that I am aware of all of the risks associated with or related to playing softball (including the possible risk of severe or fatal injury) to others or myself particulars of which include but are not limited to the following:
- All manner of injury resulting from playing whether within The Association rules or not;
- All injuries resulting from activities such as playing in a game, practice, tournament, skills competition etc.;
- Injuries resulting from faulty equipment or facilities;
- Failure of The Association to provide adequate officiating.
I acknowledge that if I choose not to wear approved and appropriate safety equipment whether contrary to the requirements of The Association or not while playing ball I am exposed to increased risk of injury or damage. I Agree: a) To assume all risks arising out of, associated with or related to my participating in ball notwithstanding that the same may have been caused or contributed to by the negligence of The Association or its breach of the duty of care prescribed by the Occupiers. Liability Act, R.S.O., 1990; b) To be solely responsible for any loss or damage I sustain, including loss or damage caused by the injury to my person or property or by my death howsoever caused and notwithstanding that the same may have been caused or contributed to by the negligence of the Association or its breach of duty of care prescribed by the Occupiers Liability Act, R.S.O., 1990; c) To save harmless, defend, indemnify, waive and release the Association from and against all manner of actions, causes of action, debts, claims, demands, general damages, special damages, sums of money, dues, costs or expenses in respect of death, injury loss or damage to any person (including my person) or property of any kind caused in any manner whatsoever, including the negligence of the Association or its breach of the duty of care prescribed by The Occupiers' Liability Act, R.S.O., 1990 arising out, associated with or related to my participation in Softball; d) Not to make any claim or take any proceeding against any other person, firm, company, entity or the Crown which may have the effect of, or where there might arise any claims against The Association for contribution or indemnity under the provisions of the Ontario Negligence Act or otherwise. e) To abide by the Coaches/Players/Parents Code of Conduct, and the Bylaws, Policies and Proceedures of the Association as written and/or amended and to further abide by the decisions of the Association and it.s representatives.
